NOTICE OF SPECIAL SCHOOL DISTRICT MEETING, PERSONAL REGISTRATION AND ABSENTEE BALLOTS

PLEASE TAKE NOTICE that a Special School District Meeting of the Liberty Central School District, Sullivan County, New York, will be held on Tuesday, January 16, 2024 (the “Election Date”) at 12:00 o’clock P.M. Noon., the Liberty High School Gymnasium, 125 Buckley Street, in Liberty, New York, at which the polls will be kept open between the hours of 12:00 o’clock P.M. Noon and 9:00 o’clock P.M., Prevailing Time, for the purpose of voting by voting machine upon the following propositions:

PROPOSITION

SCHOOL DISTRICT BUILDINGS AND FACILITIES CAPITAL PROJECT

Shall the following resolution be adopted, towit:

RESOLVED, that the Board of Education of the Liberty Central School District, Sullivan County, New York, is hereby authorized to construct improvements to and reconstruct School District buildings and related facilities, including original furnishings, equipment, machinery, apparatus, appurtenances, site improvements (including athletic field improvements), construction of a new storage building, and other incidental improvements and expenses in connection therewith, at a maximum estimated cost not to exceed $42,689,222, and that $9,900,000 of [Building Capital Reserve Fund/available fund balance] shall be used to pay a portion thereof, inclusive of $1,469,131 previously authorized by voters to be expended from the Building Capital Reserve Fund/available fund balance for a capital project that was never undertaken by the District and, thus, never, expended,  and that the remaining $32,789,222 of said amount, or so much thereof as may be necessary, shall be raised by the levy of a tax upon the taxable property of said School District and collected in annual installments as provided by Section
416 of the Education Law; and, in anticipation of such tax, obligations of said School District shall be issued.

SEQRA DETERMINATION. The School District has determined that the capital project is a “Type II Action” pursuant to 6 NYCRR Part 617.5(c)(1), (2) and (10) (formerly (8)) of the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, the School District has determined, as such, will not result in any significant adverse environmental impacts. SEQRA compliance materials are on file in the office of the School District Clerk where they may be inspected during regular office hours
upon appointment.

QUALIFIED VOTERS. The qualified voters of the School District shall be entitled to vote at said Special District Meeting and Election. A qualified voter is one (1) a citizen of the United States of America, (2) eighteen years of age or older, and (3) resident within the School District for a period of thirty (30) days next preceding the Special District Meeting and election and not otherwise prohibited from voting (i.e. mentally incompetent or convicted felon). All qualified voters must be registered to vote.

PERSONAL REGISTRATION. Notice is given that pursuant to section 2014 of the Education Law, Personal Registration of voters is required, and no person shall be entitled to vote at the Special District Meeting to be held on January 16, 2024, whose name does not appear on the register of the District or who does not register as hereinafter provided, except a person who is otherwise qualified to vote and is registered under the provisions of Article 5 of the Election Law. The times and place of registration are set forth below, and any person shall be entitled to have that person’s name placed upon such register, provided that at such meeting, that person is known or proven to the satisfaction of the District Clerk, to be then or thereafter entitled to vote at the school meeting or election for which such register is prepared. Notice is given that Personal Registration may be achieved Monday through Friday, 9:00 a.m. to 4:00 P.M. prevailing time at the Liberty Central School District Office, 115 Buckley Street, Liberty, New York up until Thursday January 11, 2023. Registration by qualified voters prior to a special district meeting must occur not more than seven days nor less than two days before the Election Date in the District Clerk’s Office.

Notice is given that the register of the District, so prepared, will be filed in the office of the School District Clerk at the Liberty Central School District Office, 115 Buckley Street, Liberty, New York, where the same shall be open for inspection by any qualified voter of the district on each of the five (5) days prior to the Special Meeting and Election, between the hours of 9:00 a.m. to 4:00 P.M., prevailing time (with the exception of Sunday, Saturday and Monday by appointment). Said register will be open for inspection at the Liberty High School Gymnasium, 125 Buckley Street, Village of Liberty, New York during the hours of the Special Meeting and Election.

ABSENTEE BALLOTS. Notice is given that applications for Absentee Ballots may be applied for at the Office of the District Clerk. If the ballot is to be mailed to the voter, the completed application must be received by the District Clerk at least seven (7) days before the election being Tuesday, January 9, 2024 at 4:00 P.M., prevailing time. If the ballot is to be delivered personally to the voter, the completed application must be received by the District Clerk no later than the day before the election, being Monday, January 15, 2024 at 4:00 P.M., prevailing time. Absentee Ballots must be received in the office of the District Clerk no later
than 5:00 P.M. prevailing time on January 16, 2024.

DISABLED VOTERS. Pursuant to the provisions of Section 2023-a of the Education Law, qualified voters who meet the criteria for “permanently disabled” and are so certified by the Sullivan County Board of Elections, will receive paper ballots by mail. A list of all persons to whom Absentee Ballots shall have been issued will be available for public inspection in the office of the District Clerk on each of the five (5) days prior to the date of the Special Meeting, weekdays between the hours of 8:00 A.M. and 4:00 P.M. prevailing time, (or Saturday, Sunday or Monday by appointment) and such list will also be posted at the polling place at the Special Meeting.

MILITARY VOTERS. Military voters who are qualified voters of the District may apply for a military ballot by requesting an application from the District Clerk at 845-292-6990 or tdefrank@libertyk12.org. For a military voter to be issued a military ballot, the District Clerk must have received a valid ballot application not later than 5:00 P.M. on December 21, 2023. In a request for a military ballot application or ballot, the military voter may indicate their preference for receiving the application or ballot by mail, facsimile transmission or electronic mail.

SNOW OR OTHER EMERGENCY CANCELLATION. In the event of a weather or other emergency which necessitates cancellation of the January 16, 2024 meeting, said Special District Meeting and Election shall be held on January 17, 2024 at the aforementioned time and place.
