Data Privacy and Security

New York State Education Law 2D, also known as the “Education Law §2-d,” is a privacy law that establishes guidelines for the collection, use, and protection of student data by educational agencies and third-party service providers in New York State. The law requires schools to create and maintain data security and privacy policies, provide notice to parents and guardians about the types of data that will be collected and how it will be used, and obtain consent before sharing certain student data with third-party vendors. Additionally, the law requires that schools implement reasonable data security practices to safeguard student data from unauthorized access, disclosure and misuse.

FERPA

The Family Educational Rights and Privacy Act (FERPA) is a law that gives parents the power to access their children’s school records, request changes to those records if needed, and have some say in who can see their children’s personal information in those records. Once a student reaches 18 years old or starts attending a college or university, these rights shift from the parents to the student, who becomes known as an “eligible student.” The specific FERPA rules can be found in the United States Code, under 20 U.S.C. § 1232g, and in the Code of Federal Regulations, under 34 CFR Part 99.

Third-party contracts

The increasing availability of online teaching and learning resources comes with concerns regarding student data, privacy, and student work. As a district we have a responsibility to ensure that student’s data and privacy are adequately protected while using online digital resources for school work.

Complaint Procedures for Unauthorized Data Disclosure/Breach

Parents/guardians, eligible students, principals, teachers, and district employees may file a complaint about a possible breach or improper disclosure of student data or protected teacher or principal data. To file a complaint, contact District Security and Privacy Officer Stacy Feasel at 845-292-5400, ext. 2332, by mail to 115 Buckley Street, Liberty NY 12754 or by email to dataprivacy@libertyk12.org.
